Q. What exactly is the age of consent in the State of Alaska? I keep hearing 16 and 18 and am just wondering which one is true? Also if I meet a girl inside a bar, take her home and we have relations, and I then discover that she is not of age, am I cool with the law because I met her in a place where everyone was supposed to be 21?
Dear Juneau Resident,
With a few exceptions, 16 is the age of consent. Exceptions include being a family member or someone having authority over the victim.
If you are considering becoming intimate it makes sense to find out how old someone is, and probably a whole bunch of other things. It wouldn’t be fun to discover the person is of age for sex but is a crazed stalker, a drug addict, has STDs or is taking secret video of you for the internet?
On the practical side, in a bar people are required to carry IDs. Comparing driver’s license pictures and laughing at them can be a good way to get a look at the date of birth.
If you decide to risk it with someone you think might be underage and plan to use an “I didn’t know how old she was.” defense remember that you get to use such a defense during an investigation. Would the experience be worth being the subject of such an investigation?
