Q. If **** **** was given a citation for negligent driving and the report said alcohol was a factor then why was she not given a DWI?

Whether or not someone gets a DWI has a lot to do with what clues of impairment are found during the investigation. The behavior that constitutes negligent driving is one clue of impairment but officers seek other clues as well. The officer observes the person, speaks with them, and usually put the driver through field sobriety tests. It is possible for someone to drive negligent, have consumed some amount of alcohol but still not have enough of the necessary signs of impairment, slurred speech,stumbling, poor balance, etc... to justify probable cause that the person is DWI.
