Q. Is the law no smoking within 10 feet of an entrance? Are there any public buildings where the 10 foot law does not apply?
Dear Juneau Resident,
If you are talking about an enclosed building where smoking is prohibited, people are required to stay more than ten feet from a door, window, or ventilation intake while smoking.
Here is the full CBJ ordinance:
36.60.025 - Reasonable distance.
Except as provided in subsection 36.60.030(7), no person may smoke within ten feet of any entrance, open window, or ventilation system intake of any building area within which smoking is prohibited by this chapter; provided, however, no person may smoke or use smokeless tobacco products anywhere within the "Hospital Tobacco-free Campus" as that area is defined in section 36.60.010(b) of this chapter.
36.60.030(7) specifies that a patio (like one used outside a bar) has the restriction of no smoking within five feet of an opening if two sides of the structure are open to the outdoors.
