Q. Is it a crime if someone threatens to hit you?
Dear Juneau Resident,
This is a simple question that seems like it should have a simple answer. Nope. Nothing about the law is simple. If the person making the threat can immediately carry out the threat, is standing right there, that is an assault. It is supporting evidence if the person has done something like this before, raises a fist, etc.. so a reasonable person would be afraid. If the person has no access to you then it is not an assault but it could be a different crime, like extortion, or coercion depending on the exact details of why the threat is being made and if the threatened person is supposed to do something to avoid getting hit (give money, not testify in court). You should report the incident so an officer can ask you those questions and see if a crime took place.
