SPECIAL MEETING NO. 99-02: The special meeting of the City and Borough of Juneau Assembly, held in the Assembly Chambers of the Municipal Building, was called to order at 5:00 p.m. by Mayor Dennis Egan.

1. CALL TO ORDER

Assembly Present: Garrett, Kibby, MacKinnon, Powell, Egan, Hagevig, Muñoz, Koelsch and Perkins.

Assembly Absent: None

A quorum was present.

Staff Present: Marian Miller, Municipal Clerk; John Corso, City Attorney; John Hartle, City Attorney.

2. Continuation of Deliberations on Mr. Steve Landvik’s Appeal of the Planning Commission’s Denial of an Allowable Use Permit to Construct a 12-Unit Apartment Building with Associated Parking (USE98-00045).

Ms. Hagevig was the presiding officer for this appeal.

Assembly Action:

MOTION – by MacKinnon, to deliberate into Executive Session, as this was an adjudicatory matter.

E X E C U T I V E S E S S I O N

12:09 p.m. – 1:10 p.m.

MOTION - by MacKinnon, to direct the City Attorney to draft a proposed decision to grant the appeal of Mr. Landvik. The five residential parking spaces would be given an allowable use permit and the allowable use permit for the twelve commercial parking spaces would be held in abeyance, delayed until the Gastineau Avenue Reconstruction Project is undertaken.

Mr. Kibby objected.
