MEETING NO. 98-19: The Special meeting of the City and Borough of Juneau Assembly, held in the Assembly Chambers of the Municipal Building, was called to order at 8:18 p.m. by Mayor Dennis Egan.
Assembly Present: Kibby, MacKinnon, Perkins, Mayor Egan, Hagevig, Muñoz, and Koelsch
Assembly Absent: Powell, and Garrett
A quorum was present.
Staff Present: Marian Miller, Municipal Clerk; Dave Palmer, City Manager; John Corso, City Attorney
1. Ordinance No. 98-18 (revised)
AN ORDINANCE APPROPRIATING MONEY OUT OF THE TREASURY FOR FY99 SCHOOL DISTRICT OPERATIONS.
Administrative Report: Attached. Mr. Palmer recommended that this ordinance be adopted.
Public Participation: None at this time.
Assembly Action:
MOTION - by Kibby, to adopt Ordinance 98-18, and he asked unanimous consent. There being no objection, it was so ordered.
MOTION – by MacKinnon, to recess into executive session to discuss pending litigation on two issues, public knowledge of which could have an adverse impact on the CBJ finances. Those two issues of pending litigation are Lumbab vs. CBJ and Alaskans for Juneau vs. EPA related to the CBJ mine permit. There being no objection, it was so ordered.

Mr. MacKinnon reported that during the executive session, the Assembly heard a report from Ms. Holbrook and Mr. Palmer on Lumbab vs. CBJ. The Assembly gave direction to them for settlement. They then discussed the Alaskans for Juneau vs. EPA appeal on the NPDES permit and gave direction to Mr. Palmer on that.
