A. Liquor Licenses

The Assembly Human Resources Committee took public testimony on the above liquor licenses at its meeting on Monday, December 19, 2005 and recommended the Assembly defer action on the Twisted Fish and Juneau Bowling Center liquor licenses for further review of their status in relationship to the smoking ordinance under CBJ Code 36.60.

The type of license the Juneau Bowling Center is applying for is a Recreational Site license, licensed by the State under AS 04.11.210, and the type of license the Twisted Fish has is a Restaurant/Eating Place license, licensed by the State under AS 04.11.100. Neither type of license fits the definition of a "bar" under CBJ smoking ordinance 36.60.005. The only exemptions allowed under CBJ Code 36.60.030 by liquor license type are those that hold a Beverage Dispensary license from the state as defined below:

36.60.005 Definitions.
In this chapter:
Bar means a beverage dispensary, other than a bar restaurant, licensed by the State of Alaska under AS 04.11.090 or AS 04.11.400(d)

36.60.030 Where smoking not regulated
(a) This chapter does not apply to:

7. bars; provided that for bars, no tobacco smoke may infiltrate into a dining room through a passageway, ventilation system, or otherwise, or into any area where smoking is prohibited,

Clerk's staff has contacted the owners of both the Twisted Fish and the Juneau Bowling Center and received confirmation that they understand that smoking is not to be allowed inside either premise.

I recommend the Assembly waive its right to protest the Renewal and Transfer of the Twisted Fish liquor license and approve their application for a Restaurant Designation Permit. I also recommend the Assembly waive its right to protest the issuance of the Juneau Bowling Center Recreational Site License and approve their application for a Restaurant Designation Permit.
