The new proposed regulations would allow a mixing zone in a fish spawning area subject to the following conditions:
1) a discharge is timed to avoid periods when fish are spawning;
2) must demonstrate that pollutants being discharged are not harmful to fish;
3) if the pollutants being discharged are potentially harmful to fish, a mitigation plan must be prepared and approved by ADF&G or DNR.
The new proposed regulations would not have any impact on the Mendenhall Treatment Plant or JD Treatment Plant since neither facility discharges into a spawning area. The AML has not taken a position on the proposed regulations. In checking with them, the only community they were aware of that had expressed a position on the proposed regulation changes was Valdez who does support them.
As this is a policy decision by the Assembly, I have no recommendation.
